Combined FONSI and Notice of Intent to Request Release of Funds TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: Name of Responsible Entity: Municipality Of Anchorage 557 East Fireweed Lane, Suite D P.O. Box 196650 Anchorage, AK 99519-6650 Telephone Number: (907) 343 4881 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Municipality Of Anchorage. REQUEST FOR RELEASE OF FUNDS On or about May 24, 2009 10:00 AM the Municipality Of Anchorage will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) program funds under 24 CFR 58.43 and 24 CFR 58.70, to undertake a project known as Habitat for Humanity Anchorage for the acquisition of three properties. 1)  Habitat plans to use $498,000 of CDBG funds for the Acquisition of 7231 East 4th and 368 Oklahoma St, Parcel # 006-061-32 and 006-061-31.  This property is 2 contiguous rectangular shaped lots measuring combined 222’ by 300’.  There are three structures on these properties, all of which will be demolished by the current property owner prior to acquisition.  The properties are zoned R-2m.  Habitat intends to construct sixteen 2-4 bedrooms townhomes connected in 2 rows.  The townhomes will be 1-3 stories, depending on land use and design capabilities   Heat will be either forced air with HRV or Radiant Baseboard. Age of Buildings on these lots per MUNI parcel details 006-061-32 Warehouse 54 years (1955) 006-061-32 second building recorded as “shed” with no dates 006-061-31 basement house 52 years (1957) 2)  Habitat plans to use $95,000 of CDBG funds and $135,000 of Neighborhood Stabilization Program (NSP) funds (Total $230,000) for the Acquisition of the currently vacant rectangular shaped lot (75’ by 300’) located at 330 Oklahoma St, Parcel # 006-061-30.  Habitat plans to construct seven 1-3 bedroom townhomes, 1-3 stories, depending on land use and design capabilities. FINDING OF NO SIGNIFICANT IMPACT The Municipality Of Anchorage has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at: Department of Neighborhoods Municipality Of Anchorage 557 East Fireweed Lane, Suite D P.O. Box 196650 Anchorage, AK 99519-6650 where the ERR can be examined or copied weekdays 8:00 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to: Department of Neighborhoods Municipality Of Anchorage 557 East Fireweed Lane, Suite D P.O. Box 196650 Anchorage, AK 99519-6650 fax at 249-7858 e-mail boehmjh@muni.org All comments received by May 24, 2009, 9:00 AM will be considered by the Municipality Of Anchorage prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing. RELEASE OF FUNDS The Municipality Of Anchorage certifies to HUD that the Municipal Manager, George Vakalis, certifying officer in his/her capacity as Official title consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Municipality Of Anchorage to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the Municipality Of Anchorage's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Name of RE; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD grant administration office at: Office of Community Planning and Development US Department of Housing and Urban Development 3000 C Street, Suite 401 Anchorage, AK 99503 Potential objectors should contact HUD to verify the actual last day of the objection period.
